Supreme Court Sacks Senator

...Orders him to refund N25.5M 2-year-Earnings


The Nigeria Supreme Court has voided the election of a sitting Senator and ordered him to refund within 90 days the salaries and allowances he had received during the two years he was in the national assembly before the judgment against him.
The apex court, which gave the judgment yesterday, order the affected Senator, Abubakar Danladi, Taraba North Senatorial District, to not only vacate his seat for the appellant, Alhaji Shuaibu Lau, he is to refund all the salaries and allowances he received while in the National Assembly, totally roughly 25.5 million naira. The total monthly salary, including allowances, of a Nigerian senator is about N1,063,860.

Alhjai Shuaibu Lau had approached the Supreme Court to challenge the ruling of a court of appeal that upturned his victory at the All Progressives Congress (APC) primary elections and was subsequently substituted.
In the unanimous judgment, the five-man-panel apex court ordered the Independent National Electoral Commission (INEC) to withdraw the certificate of return issued to Abubakar Danladi and issue a new one to Shuaibu Lau as the rightful senator representing Taraba North.
The Supreme Court held that it was wrong to have disqualified Lau after having scored the highest number of votes at the primary election, adding that it was only fair that he should have been declared the winner.
"This court hereby orders that the appellant be issued with the certificate of return and the respondent should immediately vacate the seat.
"He should return to the National Assembly, all salaries and allowances received as a senator within 90 days," the apex court ruled.
